Section 38-33.3-401 of the Colorado Common Interest Ownership Act (“CCIOA”) requires every unit owners' association to register annually with the director of the Division of Real Estate. The failure to register or renew an HOA with the Division of Real Estate may impact the association’s ability to enforce it’s covenants, pursue collection efforts or place a lien on the property of delinquent property owners.
While all associations are required to register, only associations that have greater than $5,000 in annual revenue are required to pay the registration fee. Associations that have $5,000 or less in annual revenue are still required to register but do not have to pay the registration fee.
